Adult-Use Cannabis in Michigan

Recreational cannabis is legal in Michigan for adults 21 years of age and older. Michigan voters approved Proposal 1 (Initiative 18-1) on November 6, 2018, with 55.9% of the vote, making Michigan the first Midwestern state to legalize adult-use cannabis. The first recreational sales began on December 1, 2019.

Michigan's recreational cannabis law is codified as the Michigan Regulation and Taxation of Marihuana Act (MRTMA), MCL 333.27951–333.27967. The law is administered by the Cannabis Regulatory Agency (CRA), formerly the Marijuana Regulatory Agency (MRA), within the Department of Licensing and Regulatory Affairs (LARA).

Except as otherwise provided in this act, a person 21 years of age or older may possess, use, consume, purchase, transport, or process 2.5 ounces or less of marihuana.

How Legalization Happened

Michigan's path to full legalization built on a strong medical foundation:

  • November 2008: Voters passed the Michigan Medical Marihuana Act (MMMA) with 63% of the vote, establishing the medical program and the nation's most extensive caregiver system.
  • November 6, 2018: Voters approved Proposal 1 with 55.9%, legalizing recreational cannabis under the MRTMA.
  • December 1, 2019: First recreational sales began at licensed dispensaries.
  • 2020–2024: The market exploded to $3.29 billion in 2024 sales, making Michigan the #2 state market nationally behind California, with $327.91 per capita spending.

Who Can Buy Recreational Cannabis

To legally purchase recreational cannabis in Michigan, you must:

  • Be at least 21 years old
  • Present a valid, government-issued photo ID (driver's license, passport, military ID, or state ID)
  • Purchase only from a CRA-licensed retail store

Purchase & Possession Limits

Michigan's MRTMA sets clear limits for personal possession:

Home Storage: The Locked Container Rule

You may keep up to 10 ounces of cannabis at home, but any amount exceeding 2.5 ounces must be stored in a locked container. This is a critical detail many people miss — having 10 ounces in an unlocked drawer technically violates the law.

Where You Can Buy: Licensed Stores Only

Cannabis may only be purchased from retail stores licensed by the CRA. Buying from unlicensed sources is illegal.

The Opt-Out Reality

Approximately 74% of Michigan's municipalities (~1,371 of ~1,856) have opted out of allowing cannabis businesses. This means most cities and townships do not permit dispensaries, cultivation facilities, or processors within their borders. However, opt-outs only affect businesses — personal possession, use, and home cultivation remain legal statewide regardless of local opt-out status.

Major cities that do allow cannabis businesses: Detroit, Ann Arbor, Grand Rapids, Lansing, Kalamazoo, and Traverse City.

Gifting Rules

Under the MRTMA, adults 21+ may gift cannabis to other adults 21+ without payment:

  • Up to 2.5 ounces of cannabis

The gift must be genuinely free. "Gift" transactions involving any form of compensation — hidden "donations," purchasing unrelated items for a "free" gift, or barter — are considered illegal sales.

Home Cultivation

Michigan allows home cultivation under the MRTMA:

  • 12 plants per household
  • Plants must be kept in an enclosed, locked facility
  • Plants must not be visible from a public place
  • Local governments cannot ban home cultivation

Medical patients pay only the 6% sales tax, saving approximately 34% compared to recreational purchases. This is one of the strongest reasons the medical program remains relevant.
